To be invited to come here and teach, to lecture, to impart what knowledge I have collected about poetry, about song writing has left me with a whole host of conflicting feelings. The strongest, most insistent of these concerns my late father who was an English Literature teacher at the high school I attended back in Australia. I have very clear memories of being about twelve years old and sitting, as you are now, in a classroom or school hall, watching my father, who would be standing, up here, where I am standing, and thinking to myself, gloomily and miserably, for, in the main, I was a gloomy and miserable child, "It doesn´t really matter what I do with my life as long as I don´t end up like my father". At forty years old it would appear that there is virtually no action I can take that does not draw me closer to him, that does not make me more like him. At forty years old I have become my father, and here I am, teaching.
What I wanted to do here was to talk a bit about "the love song", to speak about my own personal approach to this genre of songwriting which I believe has been at the very heart of my particular artistic quest. I want look at some other works, that, for whatever reason, I think are sublime achievements in this most noble of artistic pursuits: the creation of the great love song.
Looking back at these twenty years a certain clarity prevails. Midst the madness and the mayhem, it would seem I have been banging on one particular drum. I see that my artistic life has centered around an attempt to articulate the nature of an almost palpable sense of loss that has laid claim to my life. A great gaping hole was blasted out of my world by the unexpected death of my father when I was nineteen years old. The way I learned to fill this hole, this void, was to write. My father taught me this as if to prepare me for his own passing. To write allowed me direct access to my imagination, to inspiration and ultimately to God. I found through the use of language, that I wrote god into existence. Language became the blanket that I threw over the invisible man, that gave him shape and form. Actualising of God through the medium of the love song remains my prime motivation as an artist. The love song is perhaps the truest and most distinctive human gift for recognising God and a gift that God himself needs. God gave us this gift in order that we speak and sing Him alive because God lives within communication. If the world was to suddenly fall silent God would deconstruct and die. Jesus Christ himself said, in one of His most beautiful quotes, "Where ever two or more are gathered together, I am in your midst." He said this because where ever two or more are gathered together there is language. I found that language became a poultice to the wounds incurred by the death of my father. Language became a salve to longing.
Though the love song comes in many guises – songs of exultation and praise, songs of rage and of despair, erotic songs, songs of abandonment and loss – they all address God, for it is the haunted premises of longing that the true love song inhabits. It is a howl in the void, for Love and for comfort and it lives on the lips of the child crying for his mother. It is the song of the lover in need of her loved one, the raving of the lunatic supplicant petitioning his God. It is the cry of one chained to the earth, to the ordinary and to the mundane, craving flight; a flight into inspiration and imagination and divinity. The love song is the sound of our endeavours to become God-like, to rise up and above the earthbound and the mediocre.
The loss of my father, I found, created in my life a vacuum, a space in which my words began to float and collect and find their purpose. The great W.H. Auden said "The so-called traumatic experience is not an accident, but the opportunity for which the child has been patiently waiting – had it not occurred, it would have found another- in order that its life come a serious matter." The death of my father was the "traumatic experience" Auden talks about that left the hole for God to fill. How beautiful the notion that we create our own personal catastrophes and that it is the creative forces within us that are instrumental in doing this. We each have a need to create and sorrow is a creative act. The love song is a sad song, it is the sound of sorrow itself. We all experience within us what the Portugese call Suadade, which translates as an inexplicable sense of longing, an unnamed and enigmatic yearning of the soul and it is this feeling that lives in the realms of imagination and inspiration and is the breeding ground for the sad song, for the Love song is the light of God, deep down, blasting through our wounds.
In his brilliant lecture entitled "The Theory and Function of Duende" Frederico Garcia Lorca attempts to shed some light on the eerie and inexplicable sadness that lives in the heart of certain works of art. "All that has dark sound has duende", he says, "that mysterious power that everyone feels but no philosopher can explain." In contemporary rock music, the area in which I operate, music seems less inclined to have its soul, restless and quivering, the sadness that Lorca talks about. Excitement, often; anger, sometimes: but true sadness, rarely, Bob Dylan has always had it. Leonard Cohen deals specifically in it. It pursues Van Morrison like a black dog and though he tries to he cannot escape it. Tom Waits and Neil Young can summon it. It haunts Polly Harvey. My friend and Dirty 3 have it by the bucket load. The band Spiritualised are excited by it. Tindersticks desperately want it, but all in all it would appear that duende is too fragile to survive the brutality of technology and the ever increasing acceleration of the music industry. Perhaps there is just no money in sadness, no dollars in duende. Sadness or duende needs space to breathe. Melancholy hates haste and floats in silence. It must be handled with care.
All love songs must contain duende. For the love song is never truly happy. It must first embrace the potential for pain. Those songs that speak of love without having within in their lines an ache or a sigh are not love songs at all but rather Hate Songs disguised as love songs, and are not to be trusted. These songs deny us our humanness and our God-given right to be sad and the air-waves are littered with them. The love song must resonate with the susurration of sorrow, the tintinnabulation of grief. The writer who refuses to explore the darker regions of the heart will never be able to write convincingly about the wonder, the magic and the joy of love for just as goodness cannot be trusted unless it has breathed the same air as evil – the enduring metaphor of Christ crucified between two criminals comes to mind here – so within the fabric of the love song, within its melody, its lyric, one must sense an acknowledgement of its capacity for suffering.
In Lou Reed´s remarkable song "Perfect Day" he writes in near diary form the events that combine to make a "Perfect Day". It is a day that resonates with the hold beauty of love, where he and his lover sit in the park and drink Sangria, feed animals in the zoo, go to a movie show etc., but it is the lines that darkly in the third verse, "I thought I was someone else, someone good" that transforms this otherwise sentimental song into the masterpiece of melancholia that it is. Not only do these lines ache with failure and shame, but they remind us in more general terms of the transient nature of love itself – that he will have his day "in the park" but, like Cinderella, who must return at midnight to the soot and ash of her disenchanted world, so must he return to his old self, his bad self. It is out of the void that this songs springs, clothed in loss and longing.
Around the age of twenty, I stared reading the Bible and I found in the brutal prose of the Old Testament, in the feel of its words and its imagery, an endless source of inspiration. The Song of Solomon, perhaps the greatest love song ever written, had a massive impact upon me. Its openly erotic nature, the metaphoric journey taken around the lovers bodies – breasts compared to bunches of grapes and young deer, hair and teeth compared to flocks of goats and sheep, legs like pillars of marble, the navel- a round goblet, the belly- a heap of wheat – its staggering imagery rockets us into the world of pure imagination. Although the two lovers are physically separate – Solomon is excluded from the garden where his beloved sings – it is the wild, obsessive projections of one lover onto another that dissolve them into a single being, constructed from a series of rapturous love-metaphors.
The Song of Solomon is an extraordinary love song but it was the remarkable series of love song/poems known as the Psalms that truly held me. I found the Psalms, which deal directly with relationship between man and God, teeming with all the clamorous desperation, longing, exultation, erotic violence and brutality that I could hope for. The Psalms are soaked in suadade, drenched in duende and bathed in bloody-minded violence. In many ways these songs became the blue-print for much of my more sadistic love songs. Psalm 137, a particular favourite of mine and which was turned into a chart hit by the fab little band Boney M. is a perfect example of all I have been talking about.
The love song must be born into the realm of the irrational, absurd, the distracted, the melancholic, the obsessive, the insane for the love song is the noise of love itself and love is, of course, a form of madness. Whether it be the love of God, or romantic, erotic love – these are manifestations of our need to be torn away from the rational, to take leave of our senses, so to speak. Love songs come in many guises and are seemingly written for many reasons – as declarations or to wound – I have written songs for all of these reasons – but ultimately the love songs exist to fill, with language, the silence between ourselves and God, to decrease the distance between the temporal and the divine.
In Psalm 137 the poet finds himself captive in "a strange land" and is forced to sing a song of Zion. He swears his love to his homeland and dreams of revenge. The Psalm is ghastly in its violent sentiments, as he sings for love of his homeland and his God and that he may be made happy by murdering the children of his enemies. What I found, time and time again, in the Bible, especially the Old Testament, was that verses of rapture, of ecstasy and love could hold within them apparently opposite sentiments – hate, revenge, bloody mindedness etc. that they were not mutually exclusive. This idea has left an enduring impression on my songwriting.
Within the world of modern pop music, a world that deals ostensibly with the Love Song, but in actuality does little more that hurl dollops of warm, custard-coloured baby-vomit down the air waves, true sorrow is not welcome. But occasionally a song comes along that hides behind its disposable, plastic beat a love lyric of truly devastating proportions. "Better The Devil You Know" written by hitmakers Stock, Altkin and Waterman and sung by the Australian pop sensation Kylie Minogue is such a song. The disguising of the terror of Love in a piece of mindless, innocuous pop music is an intriguing concept. "Better The Devil You Know" is one of pop music's most violent and distressing love lyrics.

When Kylie Minogue sings these words there is an innocence to her voice that makes the horror of this chilling lyric all the more compelling. The idea presented within this song, dark and sinister and sad – that all love relationships are by nature abusive and that his abuse, be it physical or psychological, is welcomed and encouraged, shows how even the most innocuous of love songs has the potential to hide terrible human truths. Like Prometheus chained to his rock, so that the eagle can eat his liver each night, Kylie becomes love's sacrificial lamb bleating an earnest invitation to the drooling, ravenous wolf that he may devour her time and time again, all to a groovy techno beat. "I´ll take you back. I´ll take you back again". Indeed. Here the Love Songs becomes a vehicle for a harrowing portrait of humanity not dissimilar to that of the Old Testament Psalms. Both are messages to God that cry out into the yawning void, in anguish and self-loathing, for deliverance.
As I said earlier, my artistic life has centered around desire or more accurately, the need, to articulate the various feelings of loss and longing that have whistled through my bones and hummed in my blood, throughout my life. In the process I have written about two hundred songs, the bulk of which I would say, were love songs. Love songs, and therefore, by my definition, sad songs. Out of this considerable mass of material, a handful of them rise above the others as true examples of all I have talked about. Sad Waters, Black Hair, I Let Love In, Deanna, From her to Eternity, Nobody's Baby Now, Into my Arms, Lime Tree Arbour, Lucy, Straight to You; I am proud of these songs. They are my gloomy, violent, dark-eyed children. They sit grimly on their own and do not play with the other songs. Mostly they were offspring of complicated pregnancies and difficult and painful births. Most of them are rooted in direct personal experience and were conceived for a variety of reasons but this rag-tag group of love songs are, at the death, all the same thing – life lines thrown into the galaxies of the divine by a drowning man.
The reasons why I feel compelled to sit down and write love songs are legion. Some of these came clearer to me when I sat down with a friend of mine, who for the sake of his anonymity I will refer to as J.J. and I admitted to each other that we both suffered from psychological disorder that the medical profession call erotographomania. Erotographomania is the obsessive desire to write love letters. My friend shared that he had written and sent, over the last five years, more than seven thousand love letters to his wife. My friend looked exhausted and his shame was almost palpable. I suffer from the same disease but happily have yet to reach such an advanced stage as my poor friend J. We discussed the power of the love letter and found that it was, not surprisingly, very similar to the love song. Both served as extended meditations on ones beloved. Both served to shorten the distance between the writer and the recipient. Both held within them a permanence and power that the spoken word did not. Both were erotic exercises, in themselves. Both had the potential to reinvent, through words, like Pygmalion with his self-created lover of stone, one's beloved. Alas, the most endearing form of correspondence, the love letter, like the love song has suffered at the hands of the cold speed of technology, at the carelessness and soullessness of our age. I would like to look, finally, at one of my own songs that I recorded for The Boatman's Call album. This song, I feel, exemplifies much of what I´ve been talking about today. The song is called Far From Me.

Far From Me took four months to write, which was the duration of the relationship it describes. The first verse was written in the first week of the affair and is full of all the heroic drama of new love as it describes the totality of feeling whilst acknowledging the potential for pain – for you I'm dying now. It sets the two lovers it describes against an uncaring world – a world that fucks everybody over – and brings in the notion of the physical distance suggested in the title. Strangely, though, the song, as if awaiting the "traumatic experience" that I spoke of earlier to happen, would not allow itself to be completed until the catastrophe had occurred. Some songs are tricky like that and it is wise to keep your wits about you when dealing with them. I find quite often that the songs I write seem to know more about what is going on in my life than I do. I have pages and pages of fourth verses for this song written while the relationship was still sailing happily along. One such verse went:

Have such a pretty flower
And the bells of St. Mary's
Inform us of the hour
Pretty words, Innocent words, unaware that any day the bottom would drop out of the whole thing. Love songs that attach themselves to actual experience, that are a poeticising of real events have a peculiar beauty unto themselves. They stay alive in the same way that memories do and being alive, they grow up and undergo changes and develop. A love song such as Far From Me has found a personality beyond the one that I originally gave it with the power to influence my own feelings around the actual event itself. This is an extraordinary thing and one of the truly wondrous benefits of song writing. The songs that I have written that deal with past relationships have become the relationships themselves. Through these songs I have been able to mythologize the ordinary events of my life, lifting them from the temporal plane and hurling them way into the stars. The relationship described in Far From Me has been and gone but the song itself lives on, keeping a pulse running through my past. Such is the singular beauty of song-writing.
Twenty years of song-writing has now past and still the void gapes wide. Still that inexplicable sadness, the duende, the saudade, the divine discontent persists and perhaps it will continue until I see the face of god himself. But when Moses desired to see the face of God, Exodus 33, 188, he was answered that he may not endure it, no man could see his face and live. Well, me, I don´t mind. I `m happy to be sad. For the residue, cast off in this search, the songs themselves, my crooked brood of sad eyed children, rally round and in their way, protect me, comfort me and keep me alive. They are the companions of the soul that lead it into exile, that safe the overpowering yearning for that which is not of this world. The imagination desires an alternate and through the writing of the love song, one sits and dines with loss and longing, madness and melancholy ecstasy, magic, joy and love with equal measures of respect and gratitude. The spiritual quest has many faces – religion, art, drugs, work, money, sex – but rarely does the search serve god so directly and rarely are the rewards so great in doing.

The disguising of the terror of Love in a piece of mindless, innocuous pop music is an intriguing concept. "Better The Devil You Know" is one of pop music's most violent and distressing love lyrics.

When Kylie Minogue sings these words there is an innocence to her voice that makes the horror of this chilling lyric all the more compelling. The idea presented within this song, dark and sinister and sad – that all love relationships are by nature abusive and that his abuse, be it physical or psychological, is welcomed and encouraged, shows how even the most innocuous of love songs has the potential to hide terrible human truths. Like Prometheus chained to his rock, so that the eagle can eat his liver each night, Kylie becomes love's sacrificial lamb bleating an earnest invitation to the drooling, ravenous wolf that he may devour her time and time again, all to a groovy techno beat. "I´ll take you back. I´ll take you back again". Indeed. Here the Love Songs becomes a vehicle for a harrowing portrait of humanity not dissimilar to that of the Old Testament Psalms. Both are messages to God that cry out into the yawning void, in anguish and self-loathing, for deliverance.
As I said earlier, my artistic life has centered around desire or more accurately, the need, to articulate the various feelings of loss and longing that have whistled through my bones and hummed in my blood, throughout my life. In the process I have written about two hundred songs, the bulk of which I would say, were love songs. Love songs, and therefore, by my definition, sad songs. Out of this considerable mass of material, a handful of them rise above the others as true examples of all I have talked about. Sad Waters, Black Hair, I Let Love In, Deanna, From her to Eternity, Nobody's Baby Now, Into my Arms, Lime Tree Arbour, Lucy, Straight to You; I am proud of these songs. They are my gloomy, violent, dark-eyed children. They sit grimly on their own and do not play with the other songs. Mostly they were offspring of complicated pregnancies and difficult and painful births. Most of them are rooted in direct personal experience and were conceived for a variety of reasons but this rag-tag group of love songs are, at the death, all the same thing – life lines thrown into the galaxies of the divine by a drowning man.
The reasons why I feel compelled to sit down and write love songs are legion. Some of these came clearer to me when I sat down with a friend of mine, who for the sake of his anonymity I will refer to as J.J. and I admitted to each other that we both suffered from psychological disorder that the medical profession call erotographomania. Erotographomania is the obsessive desire to write love letters. My friend shared that he had written and sent, over the last five years, more than seven thousand love letters to his wife. My friend looked exhausted and his shame was almost palpable. I suffer from the same disease but happily have yet to reach such an advanced stage as my poor friend J. We discussed the power of the love letter and found that it was, not surprisingly, very similar to the love song. Both served as extended meditations on ones beloved. Both served to shorten the distance between the writer and the recipient. Both held within them a permanence and power that the spoken word did not. Both were erotic exercises, in themselves. Both had the potential to reinvent, through words, like Pygmalion with his self-created lover of stone, one's beloved. Alas, the most endearing form of correspondence, the love letter, like the love song has suffered at the hands of the cold speed of technology, at the carelessness and soullessness of our age. I would like to look, finally, at one of my own songs that I recorded for The Boatman's Call album. This song, I feel, exemplifies much of what I´ve been talking about today. The song is called Far From Me.

Far from me
Far From Me took four months to write, which was the duration of the relationship it describes. The first verse was written in the first week of the affair and is full of all the heroic drama of new love as it describes the totality of feeling whilst acknowledging the potential for pain – for you I'm dying now. It sets the two lovers it describes against an uncaring world – a world that fucks everybody over – and brings in the notion of the physical distance suggested in the title. Strangely, though, the song, as if awaiting the "traumatic experience" that I spoke of earlier to happen, would not allow itself to be completed until the catastrophe had occurred. Some songs are tricky like that and it is wise to keep your wits about you when dealing with them. I find quite often that the songs I write seem to know more about what is going on in my life than I do. I have pages and pages of fourth verses for this song written while the relationship was still sailing happily along. One such verse went:

And the bells of St. Mary's
Inform us of the hour
Pretty words, Innocent words, unaware that any day the bottom would drop out of the whole thing. Love songs that attach themselves to actual experience, that are a poeticising of real events have a peculiar beauty unto themselves. They stay alive in the same way that memories do and being alive, they grow up and undergo changes and develop. A love song such as Far From Me has found a personality beyond the one that I originally gave it with the power to influence my own feelings around the actual event itself. This is an extraordinary thing and one of the truly wondrous benefits of song writing. The songs that I have written that deal with past relationships have become the relationships themselves. Through these songs I have been able to mythologize the ordinary events of my life, lifting them from the temporal plane and hurling them way into the stars. The relationship described in Far From Me has been and gone but the song itself lives on, keeping a pulse running through my past. Such is the singular beauty of song-writing.
Twenty years of song-writing has now past and still the void gapes wide. Still that inexplicable sadness, the duende, the saudade, the divine discontent persists and perhaps it will continue until I see the face of god himself. But when Moses desired to see the face of God, Exodus 33, 188, he was answered that he may not endure it, no man could see his face and live. Well, me, I don´t mind. I `m happy to be sad. For the residue, cast off in this search, the songs themselves, my crooked brood of sad eyed children, rally round and in their way, protect me, comfort me and keep me alive. They are the companions of the soul that lead it into exile, that safe the overpowering yearning for that which is not of this world. The imagination desires an alternate and through the writing of the love song, one sits and dines with loss and longing, madness and melancholy ecstasy, magic, joy and love with equal measures of respect and gratitude. The spiritual quest has many faces – religion, art, drugs, work, money, sex – but rarely does the search serve god so directly and rarely are the rewards so great in doing.

Απόφαση-πλαίσιο 2008/913/ΔΕΥ του Συμβουλίου της 28ης Νοεμβρίου 2008 για την καταπολέμηση ορισμένων μορφών και εκδηλώσεων ρατσισμού και ξενοφοβίας μέσω του ποινικού δικαίου
ΤΟ ΣΥΜΒΟΥΛΙΟ ΤΗΣ ΕΥΡΩΠΑΪΚΗΣ ΕΝΩΣΗΣ,
Έχοντας υπόψη:
τη συνθήκη για την Ευρωπαϊκή Ένωση, και ιδίως τα άρθρα 29 και 31 και το άρθρο 34 παράγραφος 2 στοιχείο β),
την πρόταση της Επιτροπής,
τη γνώμη του Ευρωπαϊκού Κοινοβουλίου [1],
Εκτιμώντας τα ακόλουθα:
(1) Ο ρατσισμός και η ξενοφοβία αντίκεινται ευθέως στις αρχές της ελευθερίας, της δημοκρατίας, του σεβασμού των δικαιωμάτων του ανθρώπου και των θεμελιωδών ελευθεριών, καθώς και του κράτους δικαίου, αρχές στις οποίες θεμελιώνεται η Ευρωπαϊκή Ένωση και οι οποίες είναι κοινές στα κράτη μέλη.
2) Το πρόγραμμα δράσης του Συμβουλίου και της Επιτροπής όσον αφορά την άριστη δυνατή εφαρμογή των διατάξεων της συνθήκης του Άμστερνταμ για τη δημιουργία ενός χώρου ελευθερίας, ασφάλειας και δικαιοσύνης [2], τα συμπεράσματα του Ευρωπαϊκού Συμβουλίου του Τάμπερε της 15ης και 16ης Οκτωβρίου 1999, το ψήφισμα του Ευρωπαϊκού Κοινοβουλίου, της 20ής Σεπτεμβρίου 2000, σχετικά με τη θέση της Ευρωπαϊκής Ένωσης στην Παγκόσμια διάσκεψη κατά του ρατσισμού και με την κατάσταση που επικρατεί σήμερα στην Ένωση [3] και η ανακοίνωση της Επιτροπής προς το Συμβούλιο και το Ευρωπαϊκό Κοινοβούλιο για την εξαμηνιαία ενημέρωση του πίνακα αποτελεσμάτων για την παρακολούθηση της προόδου όσον αφορά τη δημιουργία ενός χώρου "Ελευθερίας, ασφάλειας και δικαιοσύνης" στην Ευρωπαϊκή Ένωση (δεύτερο εξάμηνο 2000) ζητούν την ανάληψη δράσης στον συγκεκριμένο τομέα. Στο πρόγραμμα της Χάγης της 4ης και 5ης Νοεμβρίου 2004, το Συμβούλιο υπενθυμίζει τη σταθερή του δέσμευση να αντιταχθεί σε κάθε μορφή ρατσισμού, αντισημιτισμού και ξενοφοβίας, η οποία εκφράστηκε ήδη από το Ευρωπαϊκό Συμβούλιο τον Δεκέμβριο του 2003
(3) Την κοινή δράση 96/443/ΔΕΥ του Συμβουλίου, της 15ης Ιουλίου 1996, σχετικά με την καταπολέμηση του ρατσισμού και της ξενοφοβίας [4], θα πρέπει να ακολουθήσει περαιτέρω νομοθετική δράση που θα ανταποκρίνεται στην ανάγκη για την περαιτέρω προσέγγιση των νομοθετικών και κανονιστικών διατάξεων των κρατών μελών και για την υπέρβαση των εμποδίων που παρεμβάλλονται στην αποτελεσματική δικαστική συνεργασία και τα οποία οφείλονται κυρίως στις αποκλίσεις των νομικών προσεγγίσεων στα κράτη μέλη.
(4) Σύμφωνα με την αξιολόγηση της κοινής δράσης 96/443/ΔΕΥ καθώς και τις εργασίες που πραγματοποιήθηκαν σε άλλα διεθνή φόρα, όπως το Συμβούλιο της Ευρώπης, εξακολουθούν να υπάρχουν ορισμένες δυσκολίες όσον αφορά τη δικαστική συνεργασία· κατά συνέπεια, υπάρχει ανάγκη για περαιτέρω προσέγγιση των ποινικών δικαίων των κρατών μελών, ώστε να εξασφαλισθεί η αποτελεσματική εφαρμογή σαφών και ολοκληρωμένων νομοθετημάτων προκειμένου να καταπολεμηθούν ο ρατσισμός και η ξενοφοβία.
(5) Ο ρατσισμός και η ξενοφοβία συνιστούν απειλή για τις ομάδες προσώπων που γίνονται στόχος της συμπεριφοράς αυτής. Είναι αναγκαίο να καθορισθεί κοινή προσέγγιση ποινικού δικαίου στην Ευρωπαϊκή Ένωση γι’ αυτό το φαινόμενο ώστε να εξασφαλισθεί ότι η ίδια συμπεριφορά αποτελεί αδίκημα σε όλα τα κράτη μέλη και ότι προβλέπονται αποτελεσματικές, αναλογικές και αποτρεπτικές κυρώσεις κατά των φυσικών και νομικών προσώπων τα οποία διαπράττουν τέτοια αδικήματα ή είναι υπεύθυνα γι’ αυτά.
6) Τα κράτη μέλη αναγνωρίζουν ότι η καταπολέμηση του ρατσισμού και της ξενοφοβίας απαιτεί τη λήψη ποικίλων μέτρων εντός συνολικού πλαισίου και δεν είναι δυνατόν να περιορίζεται σε ποινικά ζητήματα. Η παρούσα απόφαση-πλαίσιο περιορίζεται στην καταπολέμηση ιδιαίτερα σοβαρών μορφών ρατσισμού και ξενοφοβίας μέσω του ποινικού δικαίου. Επειδή οι πολιτιστικές και νομικές παραδόσεις των κρατών μελών είναι, σε κάποια έκταση, διαφορετικές, ειδικότερα στον τομέα αυτόν, δεν είναι δυνατή επί του παρόντος η πλήρης εναρμόνιση των ποινικών δικαίων.
(7) Στην παρούσα απόφαση-πλαίσιο, ο όρος "γενεαλογικές καταβολές" θα πρέπει να νοηθεί ως αναφερόμενος κυρίως σε πρόσωπα ή σε ομάδες προσώπων που κατάγονται από πρόσωπα τα οποία θα μπορούσαν να προσδιορισθούν βάσει ορισμένων χαρακτηριστικών (όπως φυλή ή χρώμα), χωρίς αυτό να σημαίνει υποχρεωτικά ότι όλα αυτά τα χαρακτηριστικά εξακολουθούν να υπάρχουν. Παρά το γεγονός αυτό, λόγω των γενεαλογικών καταβολών τους, τα εν λόγω πρόσωπα ή ομάδες προσώπων μπορούν να αποτελέσουν στόχο μίσους ή βίας.
8) Ο όρος "θρησκεία" θα πρέπει να νοηθεί ως αναφερόμενος γενικά σε πρόσωπα τα οποία προσδιορίζονται βάσει θρησκευτικής πίστης ή πεποιθήσεων.
(9) Ο όρος "μίσος" θα πρέπει να νοηθεί ως αναφερόμενος σε μίσος που βασίζεται στη φυλή, το χρώμα, τη θρησκεία, τις γενεαλογικές καταβολές ή την εθνική ή εθνοτική καταγωγή.
(10) Η παρούσα απόφαση-πλαίσιο δεν εμποδίζει κράτος μέλος να θεσπίζει διατάξεις εθνικού δικαίου με τις οποίες επεκτείνεται το πεδίο εφαρμογής του άρθρου 1 παράγραφος 1 στοιχεία γ) και δ) σε εγκλήματα που απευθύνονται εις βάρος ομάδας προσώπων, η οποία προσδιορίζεται βάσει άλλων κριτηρίων εκτός από εκείνα της φυλής, του χρώματος, της θρησκείας, των γενετικών καταβολών ή της εθνικής ή εθνοτικής καταγωγής, όπως είναι αυτά της κοινωνικής θέσης ή των πολιτικών πεποιθήσεων.
(11) Θα πρέπει να εξασφαλισθεί ότι η διερεύνηση και η ποινική δίωξη των αδικημάτων ρατσισμού και ξενοφοβίας δεν εξαρτάται από αναφορές ή καταγγελίες των θυμάτων, τα οποία είναι συχνά ιδιαιτέρως ευάλωτα και διστάζουν να κινήσουν δικαστικές διαδικασίες.
(12) Η προσέγγιση του ποινικού δικαίου θα πρέπει να οδηγήσει στην αποτελεσματικότερη καταπολέμηση ρατσιστικών και ξενοφοβικών αδικημάτων, με προώθηση πλήρους και ουσιαστικής δικαστικής συνεργασίας μεταξύ κρατών μελών. Το Συμβούλιο θα πρέπει να λάβει υπόψη του τις δυσχέρειες που ενδέχεται να υπάρχουν στον τομέα αυτόν όταν θα επανεξετάσει την παρούσα απόφαση-πλαίσιο προκειμένου να αποφασίσει εάν απαιτούνται περαιτέρω μέτρα στον τομέα αυτόν.
(13) Επειδή ο στόχος της παρούσας απόφασης-πλαισίου, που συνίσταται στο να εξασφαλισθεί ότι τα ρατσιστικά και ξενοφοβικά αδικήματα τιμωρούνται σε όλα τα κράτη μέλη με τουλάχιστον κατώτερο επίπεδο αποτελεσματικών, αναλογικών και αποτρεπτικών ποινών, δεν μπορεί να επιτευχθεί επαρκώς εάν τα κράτη μέλη δρουν μεμονωμένα, δεδομένου ότι οι κανόνες αυτοί πρέπει να είναι κοινοί και συμβατοί, και εφόσον αυτός ο στόχος μπορεί να επιτευχθεί καλύτερα σε επίπεδο Ευρωπαϊκής Ένωσης, η Ένωση μπορεί να θεσπίσει μέτρα σύμφωνα με την αρχή της επικουρικότητας η οποία αναφέρεται στο άρθρο 2 της συνθήκης για την Ευρωπαϊκή Ένωση και προβλέπεται στο άρθρο 5 της συνθήκης για την ίδρυση της Ευρωπαϊκής Κοινότητας. Σύμφωνα με την αρχή της αναλογικότητας που προβλέπεται στο τελευταίο αυτό άρθρο, η παρούσα απόφαση-πλαίσιο δεν υπερβαίνει τα αναγκαία όρια για την επίτευξη αυτού του στόχου.
(14) Η παρούσα απόφαση-πλαίσιο σέβεται τα θεμελιώδη δικαιώματα και τις αρχές που αναγνωρίζονται από το άρθρο 6 της συνθήκης για την Ευρωπαϊκή Ένωση και από την Ευρωπαϊκή Σύμβαση για την Προάσπιση των Δικαιωμάτων του Ανθρώπου, ιδίως τα άρθρα 10 και 11 αυτής, και αντικατοπτρίζονται στο Χάρτη Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης, και κυρίως στα κεφάλαια ΙΙ και VI.
(15) Εκτιμήσεις που αναφέρονται στην ελευθερία του συνεταιρίζεσθαι και την ελευθερία της έκφρασης, ιδίως την ελευθερία του τύπου και την ελευθερία της έκφρασης σε άλλα μέσα ενημέρωσης, έχουν οδηγήσει, σε πολλά κράτη μέλη, σε διαδικαστικές εγγυήσεις και ειδικούς κανόνες στο εθνικό δίκαιο όσον αφορά τον καθορισμό ή τον περιορισμό της ευθύνης.
(16) Η κοινή δράση 96/443/ΔΕΥ θα πρέπει να καταργηθεί επειδή, λόγω της έναρξης ισχύος της συνθήκης του Άμστερνταμ, της οδηγίας 2000/43/ΕΚ του Συμβουλίου, της 29ης Ιουνίου 2000, για την εφαρμογή της αρχής της ίσης μεταχείρισης προσώπων ανεξαρτήτως της φυλετικής ή εθνοτικής τους καταγωγής [5] και της παρούσας απόφασης-πλαισίου, έχει καταστεί άνευ αντικειμένου,
ΕΚΔΙΔΕΙ ΤΗΝ ΠΑΡΟΥΣΑ ΑΠΟΦΑΣΗ-ΠΛΑΙΣΙΟ:
Άρθρο 1
Αδικήματα ρατσισμού και ξενοφοβίας
1. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι τιμωρούνται οι ακόλουθες εκ προθέσεως τελούμενες πράξεις:
α) η δημόσια υποκίνηση βίας ή μίσους που στρέφεται κατά ομάδας προσώπων ή μέλους ομάδας, που προσδιορίζεται βάσει της φυλής, του χρώματος, της θρησκείας, των γενεαλογικών καταβολών ή της εθνικής ή εθνοτικής καταγωγής,
β) η τέλεση πράξης που αναφέρεται στο στοιχείο α) με δημόσια διάδοση ή διανομή φυλλαδίων, εικόνων ή άλλου υλικού,
γ) η δημόσια επιδοκιμασία, η άρνηση ή η χονδροειδής υποτίμηση της σοβαρότητας όσον αφορά εγκλήματα γενοκτονίας, εγκλήματα κατά της ανθρωπότητας και εγκλήματα πολέμου, όπως ορίζονται στα άρθρα 6, 7 και 8 του Καταστατικού του Διεθνούς Ποινικού Δικαστηρίου, και η οποία στρέφεται κατά ομάδας προσώπων ή μέλους ομάδας που προσδιορίζεται βάσει της φυλής, του χρώματος, της θρησκείας, των γενεαλογικών καταβολών ή της εθνικής ή εθνοτικής καταγωγής όταν η συμπεριφορά εκδηλώνεται κατά τρόπο που είναι πιθανόν να υποκινήσει βία ή μίσος στρεφόμενο κατά μιας τέτοιας ομάδας ή μέλους μιας τέτοιας ομάδας,
δ) η δημόσια επιδοκιμασία, άρνηση ή χονδροειδής υποτίμηση της σοβαρότητας των εγκλημάτων τα οποία ορίζονται στο άρθρο 6 του Καταστατικού του Διεθνούς Στρατοδικείου που προσαρτάται στη συμφωνία του Λονδίνου της 8ης Αυγούστου 1945, η οποία στρέφεται κατά ομάδας προσώπων ή μέλους τέτοιας ομάδας που προσδιορίζεται βάσει της φυλής, του χρώματος, της θρησκείας, των γενεαλογικών καταβολών ή της εθνικής ή εθνοτικής καταγωγής, όταν η συμπεριφορά εκδηλώνεται κατά τρόπο που είναι πιθανόν να υποκινήσει βία ή μίσος στρεφόμενο κατά μιας τέτοιας ομάδας ή μέλους μιας τέτοιας ομάδας.
2. Για τους σκοπούς της παραγράφου 1, τα κράτη μέλη μπορούν να επιλέγουν να τιμωρούν μόνον συμπεριφορά η οποία είτε εκδηλώνεται κατά τρόπο που διαταράσσει τη δημόσια τάξη είτε έχει απειλητικό, υβριστικό ή προσβλητικό χαρακτήρα.
3. Για τους σκοπούς της παραγράφου 1, η αναφορά στη θρησκεία θεωρείται ότι καλύπτει, τουλάχιστον, συμπεριφορά η οποία συνιστά πρόσχημα για να κατευθύνονται οι πράξεις κατά ομάδας προσώπων ή μέλους τέτοιας ομάδας που προσδιορίζεται βάσει φυλής, χρώματος, γενεαλογικών καταβολών, ή εθνικής ή εθνοτικής καταγωγής.
4. Κατά τη στιγμή της υιοθέτησης της παρούσας απόφασης-πλαισίου, ή αργότερα, οιοδήποτε κράτος μέλος έχει τη δυνατότητα να δηλώσει ότι θα τιμωρεί την πράξη άρνησης ή χονδροειδούς υποτίμησης της σοβαρότητας των εγκλημάτων που προβλέπονται στα στοιχεία γ) ή/και δ) της παραγράφου 1, μόνον εφόσον τα εγκλήματα που αναφέρονται στην εν λόγω παράγραφο έχουν αναγνωρισθεί με αμετάκλητη απόφαση εθνικού δικαστηρίου αυτού του κράτους μέλους ή/και διεθνούς δικαστηρίου ή με αμετάκλητη απόφαση διεθνούς δικαστηρίου μόνον.
Άρθρο 2
Ηθική αυτουργία, συνεργία και προτροπή
1. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι η ηθική αυτουργία στην τέλεση πράξεων που αναφέρονται στο άρθρο 1 παράγραφος 1 στοιχεία γ) και δ), τιμωρείται.
2. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι η συνεργία και η προτροπή στην τέλεση πράξεων που αναφέρονται στο άρθρο 1 τιμωρούνται.
Άρθρο 3
Ποινικές κυρώσεις
1. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι οι πράξεις που αναφέρονται στα άρθρα 1 και 2 τιμωρούνται με αποτελεσματικές, αναλογικές και αποτρεπτικές ποινικές κυρώσεις.
2. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι οι πράξεις που αναφέρονται στο άρθρο 1 τιμωρούνται με ποινικές κυρώσεις, το ανώτατο όριο των οποίων είναι ένα έως τρία έτη τουλάχιστον στέρησης της ελευθερίας.
Άρθρο 4
Ρατσιστικά και ξενοφοβικά κίνητρα
Για αδικήματα εκτός αυτών που αναφέρονται στα άρθρα 1 και 2, τα κράτη μέλη λαμβάνουν τα αναγκαία μέτρα ώστε να εξασφαλίζεται ότι τα ρατσιστικά και ξενοφοβικά κίνητρα θεωρούνται επιβαρυντικές περιστάσεις, ή, εναλλακτικά, ότι τα κίνητρα αυτά λαμβάνονται υπόψη από τα δικαστήρια κατά την επιμέτρηση της ποινής.
Άρθρο 5
Ευθύνη νομικών προσώπων
1. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι νομικό πρόσωπο μπορεί να θεωρηθεί υπεύθυνο για τις πράξεις που αναφέρονται στα άρθρα 1 και 2, εφόσον οι πράξεις αυτές τελούνται προς όφελός του από οιοδήποτε πρόσωπο, το οποίο δρα είτε σε ατομική βάση είτε ως μέλος οργάνου του νομικού προσώπου και το οποίο κατέχει διευθυντική θέση στο πλαίσιο του νομικού προσώπου, με βάση τα ακόλουθα:
α) εξουσία αντιπροσώπευσης του νομικού προσώπου,
β) εξουσία να λαμβάνει αποφάσεις εξ ονόματος του νομικού προσώπου, ή
γ) εξουσία να ασκεί έλεγχο στο πλαίσιο του νομικού προσώπου.
2. Εκτός από τις περιπτώσεις που προβλέπονται στην παράγραφο 1 του παρόντος άρθρου, κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι νομικό πρόσωπο μπορεί να θεωρηθεί υπεύθυνο όταν η έλλειψη εποπτείας ή ελέγχου εκ μέρους του προβλεπομένου στην παράγραφο 1 του παρόντος άρθρου προσώπου, καθιστά εφικτή την τέλεση πράξεων που αναφέρονται στα άρθρα 1 και 2 προς όφελος του συγκεκριμένου νομικού προσώπου από πρόσωπο που τελεί υπό την εξουσία του.
3. Η ευθύνη του νομικού προσώπου δυνάμει των παραγράφων 1 και 2 του παρόντος άρθρου δεν αποκλείει την άσκηση ποινικής δίωξης κατά φυσικών προσώπων τα οποία είναι αυτουργοί ή συνεργοί σε πράξεις που αναφέρονται στα άρθρα 1 και 2.
4. Ως "νομικό πρόσωπο" νοείται ο φορέας ο οποίος έχει την ιδιότητα αυτή δυνάμει του εφαρμοστέου εθνικού δικαίου, με εξαίρεση τα κράτη ή τους άλλους φορείς δημοσίου δικαίου κατά την άσκηση δημόσιας εξουσίας και τους διεθνείς οργανισμούς δημοσίου δικαίου.
Άρθρο 6
Κυρώσεις κατά νομικών προσώπων
1. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι το νομικό πρόσωπο που θεωρείται υπεύθυνο δυνάμει του άρθρου 5 παράγραφος 1, μπορεί να τιμωρηθεί με αποτελεσματικές, αναλογικές και αποτρεπτικές κυρώσεις, στις οποίες περιλαμβάνονται οι χρηματικές ποινές ή πρόστιμα και, ενδεχομένως, άλλες κυρώσεις, όπως:
α) μέτρα αποκλεισμού από δημόσιες παροχές ή ενισχύσεις,
β) μέτρα προσωρινής ή μόνιμης απαγόρευσης άσκησης εμπορικής δραστηριότητας,
γ) επιβολή δικαστικής εποπτείας,
δ) δικαστική εκκαθάριση.
2. Τα κράτη μέλη λαμβάνουν τα αναγκαία μέτρα ώστε να εξασφαλίσουν ότι το νομικό πρόσωπο που θεωρείται υπεύθυνο δυνάμει του άρθρου 5 παράγραφος 2, υπόκειται σε αποτελεσματικές, αναλογικές και αποτρεπτικές κυρώσεις ή μέτρα.
Άρθρο 7
Συνταγματικοί κανόνες και θεμελιώδεις αρχές
1. Η παρούσα απόφαση-πλαίσιο δεν συνεπάγεται μεταβολή της υποχρέωσης σεβασμού θεμελιωδών δικαιωμάτων και θεμελιωδών νομικών αρχών, συμπεριλαμβανομένων της ελευθερίας της έκφρασης και της ελευθερίας του συνεταιρίζεσθαι, όπως κατοχυρώνονται στο άρθρο 6 της συνθήκης για την Ευρωπαϊκή Ένωση.
2. Η παρούσα απόφαση-πλαίσιο δεν συνεπάγεται υποχρέωση των κρατών μελών να λαμβάνουν μέτρα που αντιβαίνουν προς τις θεμελιώδεις αρχές τους σχετικά με την ελευθερία του συνεταιρίζεσθαι και την ελευθερία της έκφρασης, ιδίως την ελευθερία του τύπου και την ελευθερία της έκφρασης σε άλλα μέσα ενημέρωσης, όπως προκύπτουν από τις συνταγματικές παραδόσεις ή τους κανόνες που διέπουν τα δικαιώματα, τις ευθύνες και τις διαδικαστικές εγγυήσεις για τον τύπο ή άλλα μέσα ενημέρωσης, όταν οι κανόνες αυτοί αναφέρονται στον καθορισμό ή τον περιορισμό της ευθύνης.
Άρθρο 8
Έναρξη έρευνας και άσκηση δίωξης
Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι οι έρευνες σχετικά με πράξεις που αναφέρονται στα άρθρα 1 και 2 ή η δίωξή τους δεν εξαρτώνται από αναφορά ή καταγγελία του θύματος, τουλάχιστον στις σοβαρότερες περιπτώσεις κατά τις οποίες η πράξη έχει τελεσθεί στην επικράτειά του.
Άρθρο 9
Δικαιοδοσία
1. Κάθε κράτος μέλος λαμβάνει τα απαιτούμενα μέτρα προκειμένου να θεμελιώσει τη δικαιοδοσία του σε σχέση με πράξη που αναφέρεται στα άρθρα 1 και 2, όταν η πράξη έχει τελεσθεί:
α) εν όλω ή εν μέρει στην επικράτειά του,
β) από υπήκοό του, ή
γ) προς όφελος νομικού προσώπου το οποίο έχει την έδρα του στην επικράτεια αυτού του κράτους μέλους.
2. Κατά τη θεμελίωση της δικαιοδοσίας του σύμφωνα με την παράγραφο 1 στοιχείο α), κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι η δικαιοδοσία του καλύπτει τις περιπτώσεις κατά τις οποίες οι πράξεις τελούνται μέσω συστήματος πληροφορικής και κατά τις οποίες:
α) ο δράστης τελεί την πράξη ενόσω είναι σωματικώς παρών στην επικράτειά του, ανεξάρτητα από το εάν η πράξη περιλαμβάνει υλικό που φιλοξενείται σε σύστημα πληροφορικής στην επικράτειά του,
β) η πράξη περιλαμβάνει υλικό που φιλοξενείται σε σύστημα πληροφορικής ευρισκόμενο στην επικράτειά του, ανεξάρτητα από το εάν ο δράστης τελεί την πράξη ενόσω είναι σωματικώς παρών στην επικράτειά του.
3. Τα κράτη μέλη μπορούν να αποφασίσουν να μην εφαρμόζουν ή να εφαρμόζουν μόνο σε ειδικές περιπτώσεις ή συνθήκες, τον κανόνα δικαιοδοσίας που ορίζεται στην παράγραφο 1 στοιχεία β) και γ).
Άρθρο 10
Εφαρμογή και επανεξέταση
1. Τα κράτη μέλη θεσπίζουν τα αναγκαία μέτρα για να συμμορφωθούν με τις διατάξεις της παρούσας απόφασης-πλαισίου έως τις 28 Νοεμβρίου 2010.
2. Μέχρι την ίδια ημερομηνία, τα κράτη μέλη διαβιβάζουν στη Γενική Γραμματεία του Συμβουλίου και στην Επιτροπή το κείμενο των διατάξεων με τις οποίες μεταφέρουν στο εθνικό τους δίκαιο τις υποχρεώσεις που τους επιβάλλονται δυνάμει της παρούσας απόφασης-πλαισίου. Έως τις 28 Νοεμβρίου 2013, το Συμβούλιο αξιολογεί, βάσει έκθεσης που θα καταρτίζεται με βάση τις πληροφορίες αυτές καθώς και γραπτής έκθεσης της Επιτροπής, τον βαθμό στον οποίο τα κράτη μέλη έχουν συμμορφωθεί με την παρούσα απόφαση-πλαίσιο.
3. Πριν από τις 28 Νοεμβρίου 2013, το Συμβούλιο επανεξετάζει την παρούσα απόφαση-πλαίσιο. Για την προετοιμασία της επανεξέτασης αυτής, το Συμβούλιο ερωτά τα κράτη μέλη εάν αντιμετώπισαν δυσκολίες κατά τη δικαστική συνεργασία σχετικά με τις πράξεις που αναφέρονται στο άρθρο 1 παράγραφος 1. Επιπλέον, το Συμβούλιο μπορεί να ζητήσει από την Eurojust να υποβάλει έκθεση σχετικά με το εάν οι διαφορές μεταξύ εθνικών νομοθεσιών οδήγησαν σε προβλήματα δικαστικής συνεργασίας μεταξύ των κρατών μελών στον τομέα αυτόν.
Άρθρο 11
Κατάργηση της κοινής δράσης 96/443/ΔΕΥ
Η κοινή δράση 96/443/ΔΕΥ καταργείται.
Άρθρο 12
Εδαφική εφαρμογή
Η παρούσα απόφαση-πλαίσιο εφαρμόζεται στο Γιβραλτάρ.
Άρθρο 13
Η παρούσα απόφαση-πλαίσιο αρχίζει να ισχύει την ημερομηνία της δημοσίευσής της στην Επίσημη Εφημερίδα της Ευρωπαϊκής Ένωσης.

Απόφαση-πλαίσιο 2008/913/ΔΕΥ του Συμβουλίου της 28ης Νοεμβρίου 2008 για την καταπολέμηση ορισμένων μορφών και εκδηλώσεων ρατσισμού και ξενοφοβίας μέσω του ποινικού δικαίου
ΤΟ ΣΥΜΒΟΥΛΙΟ ΤΗΣ ΕΥΡΩΠΑΪΚΗΣ ΕΝΩΣΗΣ,
Έχοντας υπόψη:
τη συνθήκη για την Ευρωπαϊκή Ένωση, και ιδίως τα άρθρα 29 και 31 και το άρθρο 34 παράγραφος 2 στοιχείο β),
την πρόταση της Επιτροπής,
τη γνώμη του Ευρωπαϊκού Κοινοβουλίου [1],
Εκτιμώντας τα ακόλουθα:
(1) Ο ρατσισμός και η ξενοφοβία αντίκεινται ευθέως στις αρχές της ελευθερίας, της δημοκρατίας, του σεβασμού των δικαιωμάτων του ανθρώπου και των θεμελιωδών ελευθεριών, καθώς και του κράτους δικαίου, αρχές στις οποίες θεμελιώνεται η Ευρωπαϊκή Ένωση και οι οποίες είναι κοινές στα κράτη μέλη.
2) Το πρόγραμμα δράσης του Συμβουλίου και της Επιτροπής όσον αφορά την άριστη δυνατή εφαρμογή των διατάξεων της συνθήκης του Άμστερνταμ για τη δημιουργία ενός χώρου ελευθερίας, ασφάλειας και δικαιοσύνης [2], τα συμπεράσματα του Ευρωπαϊκού Συμβουλίου του Τάμπερε της 15ης και 16ης Οκτωβρίου 1999, το ψήφισμα του Ευρωπαϊκού Κοινοβουλίου, της 20ής Σεπτεμβρίου 2000, σχετικά με τη θέση της Ευρωπαϊκής Ένωσης στην Παγκόσμια διάσκεψη κατά του ρατσισμού και με την κατάσταση που επικρατεί σήμερα στην Ένωση [3] και η ανακοίνωση της Επιτροπής προς το Συμβούλιο και το Ευρωπαϊκό Κοινοβούλιο για την εξαμηνιαία ενημέρωση του πίνακα αποτελεσμάτων για την παρακολούθηση της προόδου όσον αφορά τη δημιουργία ενός χώρου "Ελευθερίας, ασφάλειας και δικαιοσύνης" στην Ευρωπαϊκή Ένωση (δεύτερο εξάμηνο 2000) ζητούν την ανάληψη δράσης στον συγκεκριμένο τομέα. Στο πρόγραμμα της Χάγης της 4ης και 5ης Νοεμβρίου 2004, το Συμβούλιο υπενθυμίζει τη σταθερή του δέσμευση να αντιταχθεί σε κάθε μορφή ρατσισμού, αντισημιτισμού και ξενοφοβίας, η οποία εκφράστηκε ήδη από το Ευρωπαϊκό Συμβούλιο τον Δεκέμβριο του 2003
(3) Την κοινή δράση 96/443/ΔΕΥ του Συμβουλίου, της 15ης Ιουλίου 1996, σχετικά με την καταπολέμηση του ρατσισμού και της ξενοφοβίας [4], θα πρέπει να ακολουθήσει περαιτέρω νομοθετική δράση που θα ανταποκρίνεται στην ανάγκη για την περαιτέρω προσέγγιση των νομοθετικών και κανονιστικών διατάξεων των κρατών μελών και για την υπέρβαση των εμποδίων που παρεμβάλλονται στην αποτελεσματική δικαστική συνεργασία και τα οποία οφείλονται κυρίως στις αποκλίσεις των νομικών προσεγγίσεων στα κράτη μέλη.
(4) Σύμφωνα με την αξιολόγηση της κοινής δράσης 96/443/ΔΕΥ καθώς και τις εργασίες που πραγματοποιήθηκαν σε άλλα διεθνή φόρα, όπως το Συμβούλιο της Ευρώπης, εξακολουθούν να υπάρχουν ορισμένες δυσκολίες όσον αφορά τη δικαστική συνεργασία· κατά συνέπεια, υπάρχει ανάγκη για περαιτέρω προσέγγιση των ποινικών δικαίων των κρατών μελών, ώστε να εξασφαλισθεί η αποτελεσματική εφαρμογή σαφών και ολοκληρωμένων νομοθετημάτων προκειμένου να καταπολεμηθούν ο ρατσισμός και η ξενοφοβία.
(5) Ο ρατσισμός και η ξενοφοβία συνιστούν απειλή για τις ομάδες προσώπων που γίνονται στόχος της συμπεριφοράς αυτής. Είναι αναγκαίο να καθορισθεί κοινή προσέγγιση ποινικού δικαίου στην Ευρωπαϊκή Ένωση γι’ αυτό το φαινόμενο ώστε να εξασφαλισθεί ότι η ίδια συμπεριφορά αποτελεί αδίκημα σε όλα τα κράτη μέλη και ότι προβλέπονται αποτελεσματικές, αναλογικές και αποτρεπτικές κυρώσεις κατά των φυσικών και νομικών προσώπων τα οποία διαπράττουν τέτοια αδικήματα ή είναι υπεύθυνα γι’ αυτά.
6) Τα κράτη μέλη αναγνωρίζουν ότι η καταπολέμηση του ρατσισμού και της ξενοφοβίας απαιτεί τη λήψη ποικίλων μέτρων εντός συνολικού πλαισίου και δεν είναι δυνατόν να περιορίζεται σε ποινικά ζητήματα. Η παρούσα απόφαση-πλαίσιο περιορίζεται στην καταπολέμηση ιδιαίτερα σοβαρών μορφών ρατσισμού και ξενοφοβίας μέσω του ποινικού δικαίου. Επειδή οι πολιτιστικές και νομικές παραδόσεις των κρατών μελών είναι, σε κάποια έκταση, διαφορετικές, ειδικότερα στον τομέα αυτόν, δεν είναι δυνατή επί του παρόντος η πλήρης εναρμόνιση των ποινικών δικαίων.
(7) Στην παρούσα απόφαση-πλαίσιο, ο όρος "γενεαλογικές καταβολές" θα πρέπει να νοηθεί ως αναφερόμενος κυρίως σε πρόσωπα ή σε ομάδες προσώπων που κατάγονται από πρόσωπα τα οποία θα μπορούσαν να προσδιορισθούν βάσει ορισμένων χαρακτηριστικών (όπως φυλή ή χρώμα), χωρίς αυτό να σημαίνει υποχρεωτικά ότι όλα αυτά τα χαρακτηριστικά εξακολουθούν να υπάρχουν. Παρά το γεγονός αυτό, λόγω των γενεαλογικών καταβολών τους, τα εν λόγω πρόσωπα ή ομάδες προσώπων μπορούν να αποτελέσουν στόχο μίσους ή βίας.
8) Ο όρος "θρησκεία" θα πρέπει να νοηθεί ως αναφερόμενος γενικά σε πρόσωπα τα οποία προσδιορίζονται βάσει θρησκευτικής πίστης ή πεποιθήσεων.
(9) Ο όρος "μίσος" θα πρέπει να νοηθεί ως αναφερόμενος σε μίσος που βασίζεται στη φυλή, το χρώμα, τη θρησκεία, τις γενεαλογικές καταβολές ή την εθνική ή εθνοτική καταγωγή.
(10) Η παρούσα απόφαση-πλαίσιο δεν εμποδίζει κράτος μέλος να θεσπίζει διατάξεις εθνικού δικαίου με τις οποίες επεκτείνεται το πεδίο εφαρμογής του άρθρου 1 παράγραφος 1 στοιχεία γ) και δ) σε εγκλήματα που απευθύνονται εις βάρος ομάδας προσώπων, η οποία προσδιορίζεται βάσει άλλων κριτηρίων εκτός από εκείνα της φυλής, του χρώματος, της θρησκείας, των γενετικών καταβολών ή της εθνικής ή εθνοτικής καταγωγής, όπως είναι αυτά της κοινωνικής θέσης ή των πολιτικών πεποιθήσεων.
(11) Θα πρέπει να εξασφαλισθεί ότι η διερεύνηση και η ποινική δίωξη των αδικημάτων ρατσισμού και ξενοφοβίας δεν εξαρτάται από αναφορές ή καταγγελίες των θυμάτων, τα οποία είναι συχνά ιδιαιτέρως ευάλωτα και διστάζουν να κινήσουν δικαστικές διαδικασίες.
(12) Η προσέγγιση του ποινικού δικαίου θα πρέπει να οδηγήσει στην αποτελεσματικότερη καταπολέμηση ρατσιστικών και ξενοφοβικών αδικημάτων, με προώθηση πλήρους και ουσιαστικής δικαστικής συνεργασίας μεταξύ κρατών μελών. Το Συμβούλιο θα πρέπει να λάβει υπόψη του τις δυσχέρειες που ενδέχεται να υπάρχουν στον τομέα αυτόν όταν θα επανεξετάσει την παρούσα απόφαση-πλαίσιο προκειμένου να αποφασίσει εάν απαιτούνται περαιτέρω μέτρα στον τομέα αυτόν.
(13) Επειδή ο στόχος της παρούσας απόφασης-πλαισίου, που συνίσταται στο να εξασφαλισθεί ότι τα ρατσιστικά και ξενοφοβικά αδικήματα τιμωρούνται σε όλα τα κράτη μέλη με τουλάχιστον κατώτερο επίπεδο αποτελεσματικών, αναλογικών και αποτρεπτικών ποινών, δεν μπορεί να επιτευχθεί επαρκώς εάν τα κράτη μέλη δρουν μεμονωμένα, δεδομένου ότι οι κανόνες αυτοί πρέπει να είναι κοινοί και συμβατοί, και εφόσον αυτός ο στόχος μπορεί να επιτευχθεί καλύτερα σε επίπεδο Ευρωπαϊκής Ένωσης, η Ένωση μπορεί να θεσπίσει μέτρα σύμφωνα με την αρχή της επικουρικότητας η οποία αναφέρεται στο άρθρο 2 της συνθήκης για την Ευρωπαϊκή Ένωση και προβλέπεται στο άρθρο 5 της συνθήκης για την ίδρυση της Ευρωπαϊκής Κοινότητας. Σύμφωνα με την αρχή της αναλογικότητας που προβλέπεται στο τελευταίο αυτό άρθρο, η παρούσα απόφαση-πλαίσιο δεν υπερβαίνει τα αναγκαία όρια για την επίτευξη αυτού του στόχου.
(14) Η παρούσα απόφαση-πλαίσιο σέβεται τα θεμελιώδη δικαιώματα και τις αρχές που αναγνωρίζονται από το άρθρο 6 της συνθήκης για την Ευρωπαϊκή Ένωση και από την Ευρωπαϊκή Σύμβαση για την Προάσπιση των Δικαιωμάτων του Ανθρώπου, ιδίως τα άρθρα 10 και 11 αυτής, και αντικατοπτρίζονται στο Χάρτη Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης, και κυρίως στα κεφάλαια ΙΙ και VI.
(15) Εκτιμήσεις που αναφέρονται στην ελευθερία του συνεταιρίζεσθαι και την ελευθερία της έκφρασης, ιδίως την ελευθερία του τύπου και την ελευθερία της έκφρασης σε άλλα μέσα ενημέρωσης, έχουν οδηγήσει, σε πολλά κράτη μέλη, σε διαδικαστικές εγγυήσεις και ειδικούς κανόνες στο εθνικό δίκαιο όσον αφορά τον καθορισμό ή τον περιορισμό της ευθύνης.
(16) Η κοινή δράση 96/443/ΔΕΥ θα πρέπει να καταργηθεί επειδή, λόγω της έναρξης ισχύος της συνθήκης του Άμστερνταμ, της οδηγίας 2000/43/ΕΚ του Συμβουλίου, της 29ης Ιουνίου 2000, για την εφαρμογή της αρχής της ίσης μεταχείρισης προσώπων ανεξαρτήτως της φυλετικής ή εθνοτικής τους καταγωγής [5] και της παρούσας απόφασης-πλαισίου, έχει καταστεί άνευ αντικειμένου,
ΕΚΔΙΔΕΙ ΤΗΝ ΠΑΡΟΥΣΑ ΑΠΟΦΑΣΗ-ΠΛΑΙΣΙΟ:
Άρθρο 1
Αδικήματα ρατσισμού και ξενοφοβίας
1. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι τιμωρούνται οι ακόλουθες εκ προθέσεως τελούμενες πράξεις:
α) η δημόσια υποκίνηση βίας ή μίσους που στρέφεται κατά ομάδας προσώπων ή μέλους ομάδας, που προσδιορίζεται βάσει της φυλής, του χρώματος, της θρησκείας, των γενεαλογικών καταβολών ή της εθνικής ή εθνοτικής καταγωγής,
β) η τέλεση πράξης που αναφέρεται στο στοιχείο α) με δημόσια διάδοση ή διανομή φυλλαδίων, εικόνων ή άλλου υλικού,
γ) η δημόσια επιδοκιμασία, η άρνηση ή η χονδροειδής υποτίμηση της σοβαρότητας όσον αφορά εγκλήματα γενοκτονίας, εγκλήματα κατά της ανθρωπότητας και εγκλήματα πολέμου, όπως ορίζονται στα άρθρα 6, 7 και 8 του Καταστατικού του Διεθνούς Ποινικού Δικαστηρίου, και η οποία στρέφεται κατά ομάδας προσώπων ή μέλους ομάδας που προσδιορίζεται βάσει της φυλής, του χρώματος, της θρησκείας, των γενεαλογικών καταβολών ή της εθνικής ή εθνοτικής καταγωγής όταν η συμπεριφορά εκδηλώνεται κατά τρόπο που είναι πιθανόν να υποκινήσει βία ή μίσος στρεφόμενο κατά μιας τέτοιας ομάδας ή μέλους μιας τέτοιας ομάδας,
δ) η δημόσια επιδοκιμασία, άρνηση ή χονδροειδής υποτίμηση της σοβαρότητας των εγκλημάτων τα οποία ορίζονται στο άρθρο 6 του Καταστατικού του Διεθνούς Στρατοδικείου που προσαρτάται στη συμφωνία του Λονδίνου της 8ης Αυγούστου 1945, η οποία στρέφεται κατά ομάδας προσώπων ή μέλους τέτοιας ομάδας που προσδιορίζεται βάσει της φυλής, του χρώματος, της θρησκείας, των γενεαλογικών καταβολών ή της εθνικής ή εθνοτικής καταγωγής, όταν η συμπεριφορά εκδηλώνεται κατά τρόπο που είναι πιθανόν να υποκινήσει βία ή μίσος στρεφόμενο κατά μιας τέτοιας ομάδας ή μέλους μιας τέτοιας ομάδας.
2. Για τους σκοπούς της παραγράφου 1, τα κράτη μέλη μπορούν να επιλέγουν να τιμωρούν μόνον συμπεριφορά η οποία είτε εκδηλώνεται κατά τρόπο που διαταράσσει τη δημόσια τάξη είτε έχει απειλητικό, υβριστικό ή προσβλητικό χαρακτήρα.
3. Για τους σκοπούς της παραγράφου 1, η αναφορά στη θρησκεία θεωρείται ότι καλύπτει, τουλάχιστον, συμπεριφορά η οποία συνιστά πρόσχημα για να κατευθύνονται οι πράξεις κατά ομάδας προσώπων ή μέλους τέτοιας ομάδας που προσδιορίζεται βάσει φυλής, χρώματος, γενεαλογικών καταβολών, ή εθνικής ή εθνοτικής καταγωγής.
4. Κατά τη στιγμή της υιοθέτησης της παρούσας απόφασης-πλαισίου, ή αργότερα, οιοδήποτε κράτος μέλος έχει τη δυνατότητα να δηλώσει ότι θα τιμωρεί την πράξη άρνησης ή χονδροειδούς υποτίμησης της σοβαρότητας των εγκλημάτων που προβλέπονται στα στοιχεία γ) ή/και δ) της παραγράφου 1, μόνον εφόσον τα εγκλήματα που αναφέρονται στην εν λόγω παράγραφο έχουν αναγνωρισθεί με αμετάκλητη απόφαση εθνικού δικαστηρίου αυτού του κράτους μέλους ή/και διεθνούς δικαστηρίου ή με αμετάκλητη απόφαση διεθνούς δικαστηρίου μόνον.
Άρθρο 2
Ηθική αυτουργία, συνεργία και προτροπή
1. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι η ηθική αυτουργία στην τέλεση πράξεων που αναφέρονται στο άρθρο 1 παράγραφος 1 στοιχεία γ) και δ), τιμωρείται.
2. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι η συνεργία και η προτροπή στην τέλεση πράξεων που αναφέρονται στο άρθρο 1 τιμωρούνται.
Άρθρο 3
Ποινικές κυρώσεις
1. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι οι πράξεις που αναφέρονται στα άρθρα 1 και 2 τιμωρούνται με αποτελεσματικές, αναλογικές και αποτρεπτικές ποινικές κυρώσεις.
2. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι οι πράξεις που αναφέρονται στο άρθρο 1 τιμωρούνται με ποινικές κυρώσεις, το ανώτατο όριο των οποίων είναι ένα έως τρία έτη τουλάχιστον στέρησης της ελευθερίας.
Άρθρο 4
Ρατσιστικά και ξενοφοβικά κίνητρα
Για αδικήματα εκτός αυτών που αναφέρονται στα άρθρα 1 και 2, τα κράτη μέλη λαμβάνουν τα αναγκαία μέτρα ώστε να εξασφαλίζεται ότι τα ρατσιστικά και ξενοφοβικά κίνητρα θεωρούνται επιβαρυντικές περιστάσεις, ή, εναλλακτικά, ότι τα κίνητρα αυτά λαμβάνονται υπόψη από τα δικαστήρια κατά την επιμέτρηση της ποινής.
Άρθρο 5
Ευθύνη νομικών προσώπων
1. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι νομικό πρόσωπο μπορεί να θεωρηθεί υπεύθυνο για τις πράξεις που αναφέρονται στα άρθρα 1 και 2, εφόσον οι πράξεις αυτές τελούνται προς όφελός του από οιοδήποτε πρόσωπο, το οποίο δρα είτε σε ατομική βάση είτε ως μέλος οργάνου του νομικού προσώπου και το οποίο κατέχει διευθυντική θέση στο πλαίσιο του νομικού προσώπου, με βάση τα ακόλουθα:
α) εξουσία αντιπροσώπευσης του νομικού προσώπου,
β) εξουσία να λαμβάνει αποφάσεις εξ ονόματος του νομικού προσώπου, ή
γ) εξουσία να ασκεί έλεγχο στο πλαίσιο του νομικού προσώπου.
2. Εκτός από τις περιπτώσεις που προβλέπονται στην παράγραφο 1 του παρόντος άρθρου, κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι νομικό πρόσωπο μπορεί να θεωρηθεί υπεύθυνο όταν η έλλειψη εποπτείας ή ελέγχου εκ μέρους του προβλεπομένου στην παράγραφο 1 του παρόντος άρθρου προσώπου, καθιστά εφικτή την τέλεση πράξεων που αναφέρονται στα άρθρα 1 και 2 προς όφελος του συγκεκριμένου νομικού προσώπου από πρόσωπο που τελεί υπό την εξουσία του.
3. Η ευθύνη του νομικού προσώπου δυνάμει των παραγράφων 1 και 2 του παρόντος άρθρου δεν αποκλείει την άσκηση ποινικής δίωξης κατά φυσικών προσώπων τα οποία είναι αυτουργοί ή συνεργοί σε πράξεις που αναφέρονται στα άρθρα 1 και 2.
4. Ως "νομικό πρόσωπο" νοείται ο φορέας ο οποίος έχει την ιδιότητα αυτή δυνάμει του εφαρμοστέου εθνικού δικαίου, με εξαίρεση τα κράτη ή τους άλλους φορείς δημοσίου δικαίου κατά την άσκηση δημόσιας εξουσίας και τους διεθνείς οργανισμούς δημοσίου δικαίου.
Άρθρο 6
Κυρώσεις κατά νομικών προσώπων
1. Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι το νομικό πρόσωπο που θεωρείται υπεύθυνο δυνάμει του άρθρου 5 παράγραφος 1, μπορεί να τιμωρηθεί με αποτελεσματικές, αναλογικές και αποτρεπτικές κυρώσεις, στις οποίες περιλαμβάνονται οι χρηματικές ποινές ή πρόστιμα και, ενδεχομένως, άλλες κυρώσεις, όπως:
α) μέτρα αποκλεισμού από δημόσιες παροχές ή ενισχύσεις,
β) μέτρα προσωρινής ή μόνιμης απαγόρευσης άσκησης εμπορικής δραστηριότητας,
γ) επιβολή δικαστικής εποπτείας,
δ) δικαστική εκκαθάριση.
2. Τα κράτη μέλη λαμβάνουν τα αναγκαία μέτρα ώστε να εξασφαλίσουν ότι το νομικό πρόσωπο που θεωρείται υπεύθυνο δυνάμει του άρθρου 5 παράγραφος 2, υπόκειται σε αποτελεσματικές, αναλογικές και αποτρεπτικές κυρώσεις ή μέτρα.
Άρθρο 7
Συνταγματικοί κανόνες και θεμελιώδεις αρχές
1. Η παρούσα απόφαση-πλαίσιο δεν συνεπάγεται μεταβολή της υποχρέωσης σεβασμού θεμελιωδών δικαιωμάτων και θεμελιωδών νομικών αρχών, συμπεριλαμβανομένων της ελευθερίας της έκφρασης και της ελευθερίας του συνεταιρίζεσθαι, όπως κατοχυρώνονται στο άρθρο 6 της συνθήκης για την Ευρωπαϊκή Ένωση.
2. Η παρούσα απόφαση-πλαίσιο δεν συνεπάγεται υποχρέωση των κρατών μελών να λαμβάνουν μέτρα που αντιβαίνουν προς τις θεμελιώδεις αρχές τους σχετικά με την ελευθερία του συνεταιρίζεσθαι και την ελευθερία της έκφρασης, ιδίως την ελευθερία του τύπου και την ελευθερία της έκφρασης σε άλλα μέσα ενημέρωσης, όπως προκύπτουν από τις συνταγματικές παραδόσεις ή τους κανόνες που διέπουν τα δικαιώματα, τις ευθύνες και τις διαδικαστικές εγγυήσεις για τον τύπο ή άλλα μέσα ενημέρωσης, όταν οι κανόνες αυτοί αναφέρονται στον καθορισμό ή τον περιορισμό της ευθύνης.
Άρθρο 8
Έναρξη έρευνας και άσκηση δίωξης
Κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι οι έρευνες σχετικά με πράξεις που αναφέρονται στα άρθρα 1 και 2 ή η δίωξή τους δεν εξαρτώνται από αναφορά ή καταγγελία του θύματος, τουλάχιστον στις σοβαρότερες περιπτώσεις κατά τις οποίες η πράξη έχει τελεσθεί στην επικράτειά του.
Άρθρο 9
Δικαιοδοσία
1. Κάθε κράτος μέλος λαμβάνει τα απαιτούμενα μέτρα προκειμένου να θεμελιώσει τη δικαιοδοσία του σε σχέση με πράξη που αναφέρεται στα άρθρα 1 και 2, όταν η πράξη έχει τελεσθεί:
α) εν όλω ή εν μέρει στην επικράτειά του,
β) από υπήκοό του, ή
γ) προς όφελος νομικού προσώπου το οποίο έχει την έδρα του στην επικράτεια αυτού του κράτους μέλους.
2. Κατά τη θεμελίωση της δικαιοδοσίας του σύμφωνα με την παράγραφο 1 στοιχείο α), κάθε κράτος μέλος λαμβάνει τα αναγκαία μέτρα ώστε να εξασφαλίσει ότι η δικαιοδοσία του καλύπτει τις περιπτώσεις κατά τις οποίες οι πράξεις τελούνται μέσω συστήματος πληροφορικής και κατά τις οποίες:
α) ο δράστης τελεί την πράξη ενόσω είναι σωματικώς παρών στην επικράτειά του, ανεξάρτητα από το εάν η πράξη περιλαμβάνει υλικό που φιλοξενείται σε σύστημα πληροφορικής στην επικράτειά του,
β) η πράξη περιλαμβάνει υλικό που φιλοξενείται σε σύστημα πληροφορικής ευρισκόμενο στην επικράτειά του, ανεξάρτητα από το εάν ο δράστης τελεί την πράξη ενόσω είναι σωματικώς παρών στην επικράτειά του.
3. Τα κράτη μέλη μπορούν να αποφασίσουν να μην εφαρμόζουν ή να εφαρμόζουν μόνο σε ειδικές περιπτώσεις ή συνθήκες, τον κανόνα δικαιοδοσίας που ορίζεται στην παράγραφο 1 στοιχεία β) και γ).
Άρθρο 10
Εφαρμογή και επανεξέταση
1. Τα κράτη μέλη θεσπίζουν τα αναγκαία μέτρα για να συμμορφωθούν με τις διατάξεις της παρούσας απόφασης-πλαισίου έως τις 28 Νοεμβρίου 2010.
2. Μέχρι την ίδια ημερομηνία, τα κράτη μέλη διαβιβάζουν στη Γενική Γραμματεία του Συμβουλίου και στην Επιτροπή το κείμενο των διατάξεων με τις οποίες μεταφέρουν στο εθνικό τους δίκαιο τις υποχρεώσεις που τους επιβάλλονται δυνάμει της παρούσας απόφασης-πλαισίου. Έως τις 28 Νοεμβρίου 2013, το Συμβούλιο αξιολογεί, βάσει έκθεσης που θα καταρτίζεται με βάση τις πληροφορίες αυτές καθώς και γραπτής έκθεσης της Επιτροπής, τον βαθμό στον οποίο τα κράτη μέλη έχουν συμμορφωθεί με την παρούσα απόφαση-πλαίσιο.
3. Πριν από τις 28 Νοεμβρίου 2013, το Συμβούλιο επανεξετάζει την παρούσα απόφαση-πλαίσιο. Για την προετοιμασία της επανεξέτασης αυτής, το Συμβούλιο ερωτά τα κράτη μέλη εάν αντιμετώπισαν δυσκολίες κατά τη δικαστική συνεργασία σχετικά με τις πράξεις που αναφέρονται στο άρθρο 1 παράγραφος 1. Επιπλέον, το Συμβούλιο μπορεί να ζητήσει από την Eurojust να υποβάλει έκθεση σχετικά με το εάν οι διαφορές μεταξύ εθνικών νομοθεσιών οδήγησαν σε προβλήματα δικαστικής συνεργασίας μεταξύ των κρατών μελών στον τομέα αυτόν.
Άρθρο 11
Κατάργηση της κοινής δράσης 96/443/ΔΕΥ
Η κοινή δράση 96/443/ΔΕΥ καταργείται.
Άρθρο 12
Εδαφική εφαρμογή
Η παρούσα απόφαση-πλαίσιο εφαρμόζεται στο Γιβραλτάρ.
Άρθρο 13
Η παρούσα απόφαση-πλαίσιο αρχίζει να ισχύει την ημερομηνία της δημοσίευσής της στην Επίσημη Εφημερίδα της Ευρωπαϊκής Ένωσης.

Since geographically – or otherwise- no coherent financial district can be located on the island of Cyprus, in this manifestation of PWC the focus will be the Church’s role in shaping financial institutions and subsequently political and cultural conditions on the island. The 1st October 2010 is the official 50th anniversary of independence of Cyprus from the British Empire. This process was lead by the first president of the island, and leader of the autocephalous Church of Cyprus, Archbishop Makarios III. Through a variety of gestures, archival material and visual references PWC aim to trace the possible –even conjectural- relationships the Church of Cyprus has with market forces, master- planning, land distribution, issues of ownership, taxation, charity and other vis-a-vis the idiosyncratic presence of social engagement on the island. Also, as part of this specific installment two presentations will contextualise the economic history and development of the island and the role, presence and understanding of the public art commissioned by the Church.

Προετοιμάζονται για τη «μεγάλη βραδιά» οι καλλιτέχνες που συμμετέχουν στην εμβληματική εκδήλωση της 1ης Οκτωβρίου για τη συμπλήρωση 50 χρόνων από τη σύσταση της Κυπριακής Δημοκρατίας. Υπό την καλλιτεχνική διεύθυνση του γνωστού σκηνογράφου 'Αντη Παρτζίλη, το γενέθλιο «πάρτι» θα στοιχίσει περί τις 700 χιλιάδες ευρώ. Ανέγερση Νέου Καθεδρικού Ναού στην εντός των τοιχών Λευκωσία. Πως καταπατώνται τα ανθρώπινα δικαιώματα τον κατοίκων της περιοχής

Περιβαλλοντικές επιπτώσεις – κίνδυνος για την ανθρώπινη υγεία (πηγή Υπηρεσία Περιβάλλοντος 16-2009)
1) Από μετρήσεις του Τμήματος Επιθεώρησης Εργασίας τα επίπεδα συγκέντρωσης στην περιοχή των επικίνδυνων χημικών ουσιών κυμαίνονται ήδη σε ψηλά επίπεδα (του NO2 κυμαίνονται μεταξύ 32-40μg/m3, του SO2 κυμαίνονται μεταξύ 5-12μg/m3 και του βενζολίου κυμαίνονται μεταξύ 3,5-5μg/m3). Η περιοχή βρίσκεται σε ζώνη υψηλού κινδύνου αναφορικά με τα επίπεδα συγκέντρωσης στην ατμόσφαιρα.
Κατά την κατασκευή θα υπάρξει δραματική και κατακόρυφη επιδείνωση των πιο πάνω ήδη υπερβολικών τιμών αφού το οδικό δίκτυο θα επιβαρυνθεί με την διακίνηση 50 βαρέων φορτηγών, από τις εκπομπές των μηχανημάτων κατασκευής και από τη σκόνη που θα δημιουργηθεί από την συσσώρευση/αποθήκευση υλικών, την κατεδάφιση των δύο κτιρίων επί της Πατριάρχου Γρηγορίου Ε΄, τις εκσκαφές του υπόγειου χώρου στάθμευσης και τη διακίνηση οχημάτων.
Μετά την ολοκλήρωση των εργασιών για κάθε τελετή (γάμους, βαφτίσια, λειτουργίες) θα επιβαρύνεται η ατμόσφαιρα με τους ρύπους των περίπου 230 οχήματα. Οι οδοί θα μπλοκάρονται και θα δημιουργείται κυκλοφοριακό χάος επιβαρύνοντας περισσότερο τον χώρο πέριξ του ναού.
2) Διαπιστώθηκε επίσης ότι κατά τις εργασίες οι ποσότητες μεταχειρισμένων μηχανέλαιων θα ανέρχονται στα 3.350 λίτρα, η ημερήσια παραγωγή αστικών αποβλήτων θα ανέρχεται στα 750 λίτρα, θα υπάρξουν επιπτώσεις στο έδαφος από τα μπάζα και από την ανεξέλεγκτη απόρριψη ή διαρροή λόγω ατυχήματος στο έδαφος υγρών χημικών αποβλήτων.
Θα υπάρξουν επιπτώσεις στους φυσικούς πόρους οι οποίες θα προέρχονται από την τεράστια κατανάλωση πετρελαίου που θα ανέλθει στα…. 540 ΧΙΛΙΑΔΕΣ λίτρα.
Όλα τα χημικά θα καταλήξουν έμμεσα ή άμεσα, στο φαγητό, στο νερό, στον αέρα και κατ’ επέκταση στον οργανισμό τον κατοίκων (και όχι μόνο) της περιοχής.
3) Διαπιστώθηκε ότι θα υπάρξει επίσης τεράστια ηχητική οχληρία από τις αυξημένες διακινήσεις οχημάτων που εξυπακούεται ότι θα επηρεάσει αρνητικότατα τους περίοικους αλλά και τους μαθητές και καθηγητές του ιστορικού Παγκυπρίου Γυμνασίου.
Ζητήματα (Αν)Ασφάλειας – Κίνδυνος για την ανθρώπινη ζωή (πηγή Ε.Τ.Ε.Κ, Μάιος 2010)
1) Σύμφωνα με το ΕΤΕΚ η επιλεγείσα θέση του Νέου Καθεδρικού Ναού λόγω της μορφής και της χωρητικότητας του υφιστάμενου οδικού δικτύου της περιβάλλουσας περιοχής, με απουσία εναλλακτικών δυνατοτήτων πρόσβασης αλλά πολύ περισσότερο διαφυγής δεν θεωρείται ασφαλής! Σε περίπτωση έκτακτου συμβάντος (φωτιάς, σεισμού) πιθανότατα όσοι βρίσκονται εντός ή πλησίον του ναού, θα κινδυνεύσουν θανάσιμα.
Σύμφωνα με το Νόμο περί Πολεοδομίας και Χωροταξίας (άρθρο 11 κ.ε.)
1) Σκοπός του τοπικού σχεδίου πολεοδομίας είναι η διασφάλιση της μεθοδικής ανάπτυξης με βασικό γνώμονα το, Συμφέρον της υγείας των κατοίκων, Συμφέρον των ανέσεων των κατοίκων και το Συμφέρον της εξυπηρετήσεως και της γενικής ευημερίας της κοινότητας
2) Το τοπικό σχέδιο δύναται να προβλέπει επίσης, Την απόσταση των οικοδομών, με άλλα σημεία της περιοχής (άλλες οικοδομές κλπ), Το ύψος των οικοδομών, Την έκταση των οικοδομών, Την έκταση του χώρου στάθμευσης, Την διαφύλαξη διακίνησης στην περιοχή αν με την ανέγερση θα αχρηστευθούν υφιστάμενες οδοί.
Πως παραβιάζει η ανέγερση του ναού αυτού τα δικαιώματα των περιοίκων (και όχι μόνο)
1) Η περιοχή ανέγερσης του ναού εμπίπτει στην πολεοδομική ζώνη ιστορικού πυρήνα Πα9 με ανώτατο συντελεστή δόμησης 1.20:1, ανώτατο ποσοστό κάλυψης 0,70:1, ανώτατο αριθμό ορόφων 2 και ανώτατο ύψος ΜΟΝΟ 7 μέτρα (σε σχέση με τα 26 μέτρα του καθεδρικού)
2) Ο λόγος που η περιοχή αυτή εμπίπτει στην Πα9 και για αυτήν ισχύουν οι συγκεκριμένοι πολεοδομικοί κανόνες και συντελεστές δόμησης κλπ είναι ακριβώς για να προστατευθεί το περιβάλλον, η υγεία και η ευημερία των πολιτών η οποία προέχει έναντι όλων!!
3) Η ευρωπαϊκή αρχή της προφύλαξης του κοινοτικού δικαίου που βασίζεται στο Άρθρο 174 (πρώην άρθρο 130Ρ) της Συνθήκης του Άμστερνταμ 10/11/1997, αφορά: “τη διατήρηση, προστασία και βελτίωση της ποιότητας του περιβάλλοντος, την προστασία της υγείας του ανθρώπου, τη συνετή και ορθολογική χρησιμοποίηση των φυσικών πόρων, την προώθηση, σε διεθνές επίπεδο, μέτρων για την αντιμετώπιση των περιφερειακών ή παγκόσμιων περιβαλλοντικών προβλημάτων.”
4) Η αρχή της προφύλαξης έχει να κάνει με ΠΡΟΛΗΠΤΙΚΗ άσκηση όπου υπάρχουν βάσιμες ενδείξεις ότι απειλείται από ένα έργο ή μια ενέργεια η ποιότητα του περιβάλλοντος και η προστασία της υγείας του ανθρώπου.
Οι πιο πάνω νόμοι ισχύουν για όλους ανεξαιρέτως τους πολίτες και οργανισμούς της Κυπριακής Δημοκρατίας. Η πολιτεία επιβάλλει τους νόμους στους απλούς πολίτες και αδιαφορεί στην περίπτωση πολυεκατομμυριούχων επιχειρήσεων όπως η ηγεσία της εκκλησιάς. Η ανέγερση του ναού παραβιάζει τα ανθρώπινα δικαιώματα όλων μας και περισσότερο των κατοίκων της περιοχής.
Κανένας, κάτω από καμιά ιδιότητα και στο όνομα κανενός σκοπού, δεν δικαιούται να παραβιάζει τα δικαιώματα των πολιτών. Πόσο μάλιστα όταν αφορούν την υγεία, την ευημερία και την διαβίωση τους.
Η ηγεσία της εκκλησιάς προκαλεί το λαϊκό αίσθημα και αγνοεί τους νόμους με την κάλυψη της πολιτείας. Επιβάλλει την θέση της σαν επιχείρηση με οικονομικά συμφέροντα, κάτω από την μάσκα ενός κοινωφελούς ιδρύματος.
Όπως επιβάλλονται οι νόμοι σε όλους μας, έτσι πρέπει να επιβληθούν και στην ηγεσία της εκκλησιάς.

Ίσως διά του χορού αντιληφθούμε πως η πεταλούδα ψυχή, με την οποία παρομοιάσαμε κιόλας την Λήμνο, δεν είναι παρά οι δύο παλάμες μας, ποικίλως μετακινούμενες η μιά προς την άλλη, και συνδεόμενες με ένα ισθμό, σχηματιζόμενο από τους αντίχειρες. Ίσως μπορούμε να προχωρήσουμε έτσι περαιτέρω, χορεύοντας με τα χέρια, στους ενάλιους τόπους της καταγωγής μας, παρομοιάζοντας τις δυο παλάμες με τα πατάκια ανοιγμένου θαλάσιου όστρακου.

PUBLIC WORKS

Εντός του κατακερματισμένου και δι-πολικού κέντρου της Λευκωσίας οι κληρονομιές του 20ου αιώνα και οι μεταμορφώσεις του 21ου, προκαλούν τη μοιρασμένη τούτη πόλη σε μια ενδοσκόπηση έναντι των αξιώσεων της ως παραγωγός στο διεθνές πολιτιστικό λεξιλόγιο/προσκήνιο και τα μελλοντικά αρχιτεκτονικά της βήματα. Απ' την άλλη η τέχνη, αφήνοντας πίσω την πρόκληση των συστημάτων παράγωγης γνώσης, μέσω της αισθητικής εμπειρίας αναδιπλώνεται εξω-ιδρυματικά, διαλογικά, συνομιλητικά, δημόσια. Ένα ρόλο που μπορεί να αποκτήσει η τέχνη είναι να μας προκαλέσει να σκεφτούμε τον κόσμο μας εκ νέου, να μας προκαλέσει να αναθεωρήσουμε την αίσθηση της κοινότητας μας. Πώς ανταποκρίνεται η Λευκωσία, με τις πολλαπλές και μοιρασμένες κοινότητές της σε αυτές τις εξελίξεις; Ποια είναι η ευθύνη μας ως καλλιτέχνες, πολιτιστικοί παραγωγοί, αρχιτέκτονες, ιστορικοί, θεωρητικοί στη διαμόρφωση της πόλης ως κοινότητας; Πώς χρησιμοποιούνται οι οπτικές γλώσσες και πώς θα μπορούσαν να διαμορφωθούν για να αλληλεπιδράσουν του δημόσιου, κοινού χώρου και του κοινού ως έχει;
Το Public Works που θα λάβει χώρα στις 1,2 και 3 Ιουλίου 2010 στην APOTHEKE (και) στην παλιά πόλη της Λευκωσίας, βασίζεται σε δυο άξονες.
Ο πρώτος άξονας αφορά αυτό καθαυτό το συνέδριο και τις δημόσιες εκδηλώσεις. Το Public Works είναι χωρισμένο σε ένα απόγευμα συζητήσεων, παρουσιάσεων και διαλέξεων από Κύπριους και ξένους ερευνητές, καλλιτέχνες και ιστορικούς (Σαββατο 3 Ιουλίου) και μια σειρά δημόσιων παρουσιάσεων και εργαστηρίων στην πόλη της Λευκωσίας (1 και 2 Ιουλίου.
Ο δεύτερος άξονας θα είναι η μετέπειτα μετάφραση στα ελληνικά κειμένων μείζονος σημασίας όσο αφορά τη σχέση συμμετοχής, κοινού χώρου και τέχνης και η έκδοση τους σε ένα τόμο όπου θα γίνονται και αναλυτικές συγκριτικές αναφορές σε έργα και δράσεις από την Κύπρο, που άπτονται της πιο πάνω σχέσης και των ατόμων που συνέβαλλαν στο Public Works.
Το Public Works θα επιχειρήσει να ανιχνεύσει και να εξερευνήσει:
• Τη Λευκωσία ως χώρο και τόπο συγκρούσεων.
• Το δημόσιο αστικό χώρο και τις επακόλουθες καλλιτεχνικές χρήσεις του.
• Το κοινό και τους πληθυσμούς του που κατοικούν στη Λευκωσία, την αντιπροσώπευσή του(ς) και το πώς και εάν η τέχνη θα μπορούσε να επηρεάσει την ένταξη τους στο πολιτιστικό προσκήνιο της χώρας.
• Ιστορικά και θεωρητικά παραδείγματα κοινωνικής και κοινοτικής εφαρμογής της τέχνης και την πιθανή ανάγκη εισαγωγής του λεξιλογίου και της βιβλιογραφίας τέτοιας εμπλοκής στο Κυπριακό πολιτιστικό τοπίο.
• Την τέχνη ως διαπραγματευτή συγκρούσεων και διαφορών.
Τα εργαστήρια θα περιλαμβάνουν:
• Παιδικό εργαστήρι ανάκτησης ενός 'νεκρού' δημόσιου χώρου και την προσωρινή ανάπλαση του ως παιδική χαρά
• 'Ξενάγηση' στη Λευκωσία μέσα από τα stencils, τα graffiti και από άλλα είδη δημόσιας οπτικής επικοινωνίας
• Παρουσιάσεις από διάφορες ομάδες που δρουν στη Λευκωσία, με αναφορά στη σχέση τους με την πόλη και τους κατοίκους της
• Χοροθέατρο στο δημόσιο χώρο, βασισμένο στην επαφή με το κοινό
• Αναδρομική έκθεση στην APOTHEKE συνεργατικών, κοινοτικά εμπλεκόμενων και διαλογικών έργων και δράσεων Κυπρίων καλλιτεχνών

In the bi-polar centre of Nicosia the legacies of the C20th and the transformations of the C21st are challenging this divided city to introspection, vis-a-vis its claims to an international vocabulary, however ignored, and its architectonic steps forward. Moving on from the modernist legacy of challenging systems of knowledge through aesthetic experiences, art forms have developed into the manifestations of littoral, conversational or dialogue based public art. A role that art can assume is to challenge us to think of our world anew and trigger thought on our sense of community. How does Nicosia's fragmented sense of community respond to such developments? How are we – art practitioners, cultural producers, architects, historians, theorists - responsible in shaping that community and how visual language is used to interact not only with a highly charged public space but also with the public that inhabits that space?
Public Works, will be held on the 1st, 2nd and 3rd of July 2010 at APOTHEKE and across the Old Town of Nicosia.
will be divided into an afternoon of curated discussions and short presentations on the 3rd July 2010 and a more active engagement with the public space of the locale on the 1st and 2nd of Julyl, attempting to explore issues re:
*Nicosia as a space and place of conflicts.
*The public sphere and the subsequent and diverse uses of art in this specific locale.
*The public(s) that inhabits Nicosia, the degrees of its representations, and how and if art can attribute a visual voice.
*Historical and theoretical paradigms of social engagement through the arts and the importance of introducing such vocabulary into the Cypriot setting.
*Art as a contact zone for conflict resolution.
The workshops and events will also include:
* A workshop with children, aiming to reclaim and construct one of the numeorus temporary car parks in the city sprouting on evry other empty lot and transform it into an ad-hoc playground.
*A tour of stencils and graffiti and their importance as a form of visual communication and social engagement in the walled part of Nicosia by graffiti artists, taggers and activists.
*A presentation by the auotnomous left group of the history of their rich relationship with the city of Nicosia.
*A sensory challenge through a collaborative dance performance.
*A street party - a hisotrically traceable mode of public engagement with the city that has attracted multiple reactions and has partly rekindled the public interest for the Old Town of Nicosia.
*An exhibition of past and present collaborative, community-based and socio-spatially involved works at APOTHEKE.
*A radiophonic engagement with the space of the walled city

...τζίαι μετά ερώτησα τον με τα μάθκια να ξαναρωτήσει ναι τζίαι μετά ερώτησεν με αν ναι εν να πω ναι αγριολουλούδο μου τζιαι πρώτα έβαλαν τον μεσ' τ' αγκάλια μου τζίαι έσφυξα τον πάνω μου να νιώσει τα βυζία μου τα μουσκομυριστά ναι τζίαι η καρκιά του εφάκαν όπως την πελλή τζίαι ναι είπα ναι, ναι ρε Ναι.
